Please read these Terms carefully. They set out the rules for using ZamaCar and explain what content and behaviour are not allowed—including political or unrelated material that does not belong on our car marketplace.
1. Agreement to these terms
- These Terms & Conditions (“Terms”) govern your access to and use of the ZamaCar website, mobile application, and related services (together, the “Service”), operated by the provider of ZamaCar (“we”, “us”, “our”).
- By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
- We may update these Terms from time to time. The “Last updated” date at the top of this page will change when we do. Your continued use after changes constitutes acceptance of the revised Terms, except where applicable law requires otherwise.
- These Terms are intended to be professional and clear. They do not replace legal advice for your specific situation.
2. Nature of the Service
- ZamaCar is an online car marketplace that allows users to list, browse, and inquire about motor vehicles and related automotive content in permitted regions.
- The Service is provided for lawful, commercial, and personal use strictly in connection with buying, selling, or researching vehicles and legitimate automotive services directly related to those activities.
- We are a platform. Unless we explicitly state otherwise, we are not a party to any sale, purchase, or agreement between users. Users are solely responsible for their dealings with one another, including payment, transfer of title, inspection, and compliance with law.
3. Eligibility and accounts
- You must be legally able to enter a binding contract in your jurisdiction to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate registration information and keep it up to date.
- We may refuse registration, suspend, or terminate accounts that violate these Terms or pose a risk to the Service or other users.
4. Acceptable use — purpose of the Service
- You agree to use the Service only for its intended purpose: facilitating the listing, discovery, and communication regarding motor vehicles and directly related automotive matters (for example, genuine inquiries about a listed vehicle, spare parts clearly tied to a vehicle sale context where permitted by our rules).
- All content you submit—including text, images, usernames, profile information, listing descriptions, and messages—must be relevant to this purpose and must comply with these Terms and applicable law.
5. Prohibited content and conduct
- The following are strictly prohibited. This list is illustrative, not exhaustive. We may remove content or restrict accounts at our discretion for behaviour that undermines the integrity or purpose of the Service.
- 5.1 Political and ideological content: You must not post, upload, embed, or promote political campaigns, parties, candidates, referendums, petitions, slogans, flags or symbols used primarily for political messaging, partisan commentary, or any content whose primary purpose is political advocacy, mobilisation, or debate. The Service is for vehicles and related marketplace activity only—not for politics.
- 5.2 Unrelated or off-topic content: You must not use the Service to promote or distribute content unrelated to the car marketplace, including but not limited to: general advertising for non-automotive businesses; job postings unrelated to automotive roles we may not expressly allow; fundraising; religious proselytising; personal blogs; entertainment or viral content; cryptocurrency or investment schemes; or any material that does not reasonably belong on a vehicle listing or buyer–seller communication in context.
- 5.3 Illegal or harmful activity: No unlawful goods or services; no fraud, impersonation, or misrepresentation; no harassment, threats, hate speech, or discrimination; no sexual or exploitative content involving minors; no malware, scraping that violates our rights, or attempts to disrupt the Service.
- 5.4 Misleading listings: No false or materially misleading descriptions, prices, mileage, condition, ownership, or images (including stock photos presented as the actual vehicle without clear disclosure where misleading).
- 5.5 Spam and manipulation: No bulk unsolicited messages, fake listings, review manipulation, or artificial inflation of metrics.
- 5.6 Intellectual property and privacy of others: Do not post content you do not have the right to use; do not publish others’ personal data without lawful justification.
6. Listings, images, and user content
- You retain ownership of content you submit, but you grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute such content on and through the Service for operating, promoting, and improving the platform.
- Listings should feature the actual vehicle (or clearly labelled representative media where appropriate and not misleading). Images and text must not contain prohibited material described in Section 5.
- You represent that your listings and communications do not violate these Terms or third-party rights.
7. Moderation, removal, and enforcement
- We may review, edit, refuse, remove, or restrict any content or account that we believe violates these Terms, applicable law, or the interests of users or the Service.
- We are under no obligation to monitor all content but may do so. Decisions on moderation are at our reasonable discretion.
8. Intellectual property of ZamaCar
- The Service, including branding, logos, layout, and software, is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works without our prior written consent.
9. Disclaimers
- The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
- We do not warrant uninterrupted or error-free operation, nor the accuracy of user-generated listings. Users must exercise their own judgment and due diligence when transacting.
10. Limitation of liability
- To the maximum extent permitted by applicable law, we and our affiliates, directors, and personnel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service or interactions with other users.
- Our aggregate liability for claims arising from the Service shall not exceed the greater of (a) the amounts you paid us specifically for the Service in the twelve months before the claim, or (b) a nominal fixed sum where you have not paid fees, unless mandatory law provides otherwise.
11. Indemnification
- You agree to indemnify and hold harmless ZamaCar and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any rights of another party.
12. Suspension and termination
- We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to the Service or third parties.
- You may stop using the Service at any time. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.
13. Governing law and disputes
- These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
- Courts located in Pakistan shall have non-exclusive jurisdiction over disputes arising from these Terms or the Service, subject to any mandatory rights you may have in your place of residence.
